Terms of Use

These Terms of Use set out the rules for using the indoor golf studio “TERVEX GOLF” (the “Facility”), operated by Higuchi Golf Co., Ltd. (“we” or “us”). The Facility may only be used by those who agree to these Terms.

[Introduction]

・The purpose of the Facility is to enrich users’ golf lives and contribute to the maintenance and improvement of their health through the provision of various golf-related services.

[Membership Types]

・The Facility may only be used by those approved by us. Users must book through the designated reservation method and complete a first-time trial session and facility orientation. Minors, adult wards, persons under conservatorship, or persons under assistance require the consent of a legal representative.

・There are two membership types: (1) Visitor, and (2) Monthly Plan Member.

– “Visitor” refers to someone who does not use the facility on a regular basis, but pays a one-time fee each time they use it (i.e., anyone other than (2) below).

– “Monthly Plan Member” refers to someone who has purchased a monthly plan and whose plan remains active.

・First-time Monthly Plan Members will be charged a designated enrollment fee. Enrollment fees and monthly fees already paid are non-refundable for any reason.

・Membership may not be lent, transferred, or reassigned to another person.

・A member will lose their membership if any of the following applies:

・Upon death

・Upon expulsion for a prohibited act

[Notes on Use]

・Use of the Facility is limited to those who meet all of the following conditions. Please note that if a user is found not to meet these conditions while receiving service, we may suspend that service.

・Able to comply with these Terms of Use and other Facility rules

・In good health, with no exercise restrictions from a doctor

・Not an adult ward or a person under conservatorship

・Free of infectious diseases, contagious diseases, mental illness, or similar conditions

・Not having excessive tattoos. This does not apply if the tattoos can be covered by clothing so they are not visible to other guests in the studio.

・Not affiliated with organized crime groups

・Not a member of, or involved with, antisocial forces

・Not pregnant

・If a minor, having obtained parental consent

・Not a competitor in the same industry

・Otherwise deemed appropriate following review at each facility

・The following persons may not use the Facility:

・Persons under the influence of alcohol

・Persons with a fever of 37.5°C or higher

・Persons using legally controlled substances

・Persons who demand acts unrelated to the Facility’s services

・Persons otherwise deemed inappropriate by staff

・The following acts are prohibited. If discovered, the member will be expelled, and fees already paid will not be refunded.

・Touching a staff member’s body

・Poaching staff by a competitor

・Defaming or slandering us, the Facility (including staff), or other users (including posts on social media or the internet), or damaging their honor or reputation

・Selling goods, conducting business, or soliciting at the Facility without permission

・Intentionally damaging Facility equipment

・Smoking or drinking alcohol inside the Facility

・Obstructing the operations of us or the Facility (including staff)

・Stalking or other conduct that inconveniences staff or other users or interferes with use of the Facility

・Exchanging contact information with staff

・Acts that violate these Terms or applicable laws and regulations

・Other acts equivalent to the above

・If a user requests a service not on the menu, or if staff determine a service cannot be provided, we may immediately discontinue service and ask the user to leave. Fees paid in that case are non-refundable, and the user may be asked to refrain from using the Facility in the future.

・Use of the Facility is in principle by advance reservation only. Reservation times and methods are based on our designated reservation system. If a system malfunction occurs, we will make reasonable efforts to contact users with alternative arrangements, but we are not liable for any resulting damages.

・If a user causes damage to us or a third party while using the Facility, that user shall be responsible for and compensate such damage.

[Late Arrivals and Cancellations]

・If you will be more than 5 minutes late for a reservation with staff present (such as a lesson or fitting), please contact us. The end time cannot be extended even if you are late, and no refund will be given for the shortened session. If more than 20 minutes pass without contact, the reservation will be treated as canceled.

・Bay reservations may be canceled up to 40 minutes before the reservation time. Please note that additional fees for lesson or fitting reservations are non-refundable.

However, this excludes the following cases:

・A schedule change or cancellation requested by us

・If a natural disaster or circumstances on our part make operation difficult, we will contact reserved customers and cancel their reservation (without consuming a ticket). If the Facility is operating, cancellations due to customer circumstances not attributable to us, such as train delays, will be treated as same-day cancellations.

・If a user repeatedly no-shows, cancels at the last minute, or arrives late, we may suspend reservation acceptance, restrict use, or revoke membership.

[About Monthly Plans]

・Payment is made by credit card through the payment processor integrated with our reservation system. For the first payment, you will be charged for the current month (prorated), the following month, and the enrollment fee. After that, payment for the following month is charged on the 25th of each month.

・A plan suspension will take effect at the end of the current month if the procedure is completed by the 20th of that month. (If completed on or after the 21st, it will take effect at the end of the following month.)

・A plan cancellation will take effect at the end of the current month if the procedure is completed by the 20th of that month. (If completed on or after the 21st, it will take effect at the end of the following month.) Re-enrollment after cancellation will incur a new enrollment fee.

・A plan change will begin on the 1st of the following month if the procedure is completed by the 20th of the current month.

・To resume a suspended plan, contact us by the 20th of the month and it will resume on the 1st of the following month.

・Suspension is available once, for up to one year, during which no fees are charged. If one year passes without a request to resume, the membership will be automatically canceled.

[Disclaimer]

・When engaging in activities at the Facility, users shall follow staff instructions and act at their own responsibility.

・We bear no responsibility for injuries or other accidents occurring during or outside use of the Facility, unless caused by our willful misconduct or gross negligence.

・We are also not liable for injuries or health issues that occur after using the Facility.

・Users are responsible for managing their own belongings brought into the Facility. We bear no responsibility for the loss or theft of valuables at the Facility, except where caused by our willful misconduct or gross negligence.

・Lost items will be kept for one month before being disposed of.

・We do not intervene in disputes or troubles between users or with other third parties.

・In rare cases, a facial recognition system malfunction may prevent entry at the reserved time. This may not be resolved immediately, especially during unstaffed hours or late night/early morning, and we are unable to compensate fees in such cases.

・During hours when no staff is present, users are responsible for their own safety and health while using the Facility. In an emergency, please contact emergency services or the police directly as needed.

[Operations and Management]

・We may establish and change rules regarding the operation and management of the Facility, including its use.

・Contact with us must be made by email. We do not offer phone support.

・Closed days are days designated by us for equipment inspection, maintenance, renovation, or other reasons.

・Business hours are those set by each studio.

・We may revise enrollment fees, usage fees, and other charges in consideration of changes in social and economic conditions.

・These Terms may be revised from time to time. Revised Terms take effect from the moment they are published on our website, and the latest version always applies regardless of prior versions.

・We may suspend use of the Facility or cancel reservations due to equipment failure, power outage, disaster, administrative guidance, or other circumstances not attributable to us.

・We handle users’ personal information to the extent necessary for reservation management, payment, identity verification, communication, safety management, and other Facility operations.

[Other Guidelines for a Pleasant Experience]

・Leaving: Please finish tidying up by the :55 mark and complete your exit by the top of the hour. Return rental items and balls to their original location. You may leave the lights and air conditioning on, but please turn off Trackman using the orange button.

・Entering: The door can be unlocked from 5 minutes before your reservation, but please be considerate and avoid pressuring the previous guest to leave early.

・Extensions: Please do not play beyond the extension time allowed under your membership plan.

・Guests: If bringing more guests than your membership plan allows, please consult the studio in advance. A one-time fee will apply.

・If damage is caused by a guest’s actions, the reserving party or member shall bear responsibility.

・Food & Drink: Outside food and alcohol are not permitted. To protect the turf, please also avoid dark-colored beverages where possible.

・Damage: Please do not swing outside the designated bay area. The ceiling contains important equipment such as the Trackman unit, projector, and lighting. Full repair costs will be charged for damage caused by swinging outside the bay, dangerous conduct, or intentional acts. To prevent screen damage, please also refrain from using your own balls.

・Lessons: Friends may teach each other, but if any money changes hands, this must always go through the studio.

・Interaction: Please refrain from unilaterally talking to or interfering with guests in neighboring bays. Extra consideration is needed where there is an age or gender difference (except where both parties are already comfortable with each other).

・Noise: Please refrain from actions that disturb others, such as clicking your tongue loudly, shouting, or slamming a club on the ground.

・As we operate 24 hours a day, security cameras are installed. Footage may be used for safety management, incident verification, equipment damage checks, and provision to relevant authorities as needed.

・Accidents, injuries, or equipment damage resulting from the use of a user’s own clubs, balls, or other equipment are the user’s responsibility.

・These Terms are governed by the laws of Japan. Any disputes relating to the Facility shall be subject to the exclusive jurisdiction of the court with jurisdiction over our registered address as the court of first instance.

By making a reservation or application to use the Facility, you are deemed to have agreed to the above Terms of Use.
